Re: New home for list needed-a Case Against Yahoo

hi,
i checked for the same thing in the google terms of use yesterday. then i accidentally mailed it to barry kleider personally, instead of to the list.
i'm still against yahoo and google, but just to keep things fair. here it is again:

/old mail:

while i'm definitely against google or yahoo, i don't think this is true. could you name a source for that?
i just had a quick look through the terms of use as displayed when making a new google account:

the first part of 9.1 could be interpreted in such a way, but i think it's only about the program/ idea/ design of the service google provides, not the content you put on there. paragraph 11 deals with that aspect.

copy&paste:

9.1 You acknowledge and agree that Google (or Google’s licensors) own all legal right, title and interest in and to the Services, including any intellectual property rights which subsist in the Services (whether those rights happen to be registered or not, and wherever in the world those rights may exist). You further acknowledge that the Services may contain information which is designated confidential by Google and that you shall not disclose such information without Google’s prior written consent.

9.4 Other than the limited license set forth in Section 11, Google acknowledges and agrees that it obtains no right, title or interest from you (or your licensors) under these Terms in or to any Content that you submit, post, transmit or display on, or through, the Services, including any intellectual property rights which subsist in that Content (whether those rights happen to be registered or not, and wherever in the world those rights may exist). Unless you have agreed otherwise in writing with Google, you agree that you are responsible for protecting and enforcing those rights and that Google has no obligation to do so on your behalf.

11. Content licence from you

11.1 You retain copyright and any other rights you already hold in Content which you submit, post or display on or through, the Services. By submitting, posting or displaying the content you give Google a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive licence to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute any Content which you submit, post or display on or through, the Services. This licence is for the sole purpose of enabling Google to display, distribute and promote the Services and may be revoked for certain Services as defined in the Additional Terms of those Services.

11.2 You agree that this licence includes a right for Google to make such Content available to other companies, organizations or individuals with whom Google has relationships for the provision of syndicated services, and to use such Content in connection with the provision of those services.

11.3 You understand that Google, in performing the required technical steps to provide the Services to our users, may (a) transmit or distribute your Content over various public networks and in various media; and (b) make such changes to your Content as are necessary to conform and adapt that Content to the technical requirements of connecting networks, devices, services or media. You agree that this licence shall permit Google to take these actions.

11.4 You confirm and warrant to Google that you have all the rights, power and authority necessary to grant the above licence.

What a conspiracy theory! (And misinformation.) Would you please take
the trouble to read the following?

Yahoo Copyright and Intellectual Property Policy:
http://info.yahoo.com/copyright/us/details.html

Yahoo! Terms of Service:
http://info.yahoo.com/legal/us/yahoo/utos/utos-173.html

1. No one is obliged to use the web interface, subscribers who wish so
may just stay with the usual email style (with options such as daily
digest if they like)... That's the whole point of suggesting those
services. I don't like web-only forums too.
2. The achives won't (and can't) be transferred to the new established
list. OTOH, somebody may have already done that already, by
automatically forwarding messages to another list / group. I remember
seeing our messages in irrelevant sites... So, that's a moot point.
3. You own the copyright of the content you provide. (See the first link.)

Anyway, I'm more interested in the continuation of the list (and to
learn and to share), so I'll be there wherever the list gets migrated.

Regards,
Loris.

In addition to the concerns I voiced earlier about technical hassles on
yahoo, I have real concerns about copyright/licensing issues with yahoo and
other commercial concerns, and would be especially uneasy if the archives
were to be transferred to one of those companies.
