DEAR LIST,
I think the key word about educational Fair Use is "excerpts". If the
teacher makes 30 copies of an "excerpt" that is fair use. If it is the
entire piece that is infringement...I believe that is how it was explained
to me by my copyright lawyer when I lived in NYC in the early 90s.
I also think Warhol's Marilyns came under the definition of "derivative
works" but Stern was not amused. I used to work freelance for Handy Andy
(Interview magazine) and he wanted to be able to use the photos from
Interview {for which we freelance photogs were paid (Great Scott! Holmes!)
$100 per page} to make his $40,000 per pop silk screens. needless to say,
not many of us signed THAT one!
