As I recall, the school wanted a simple document to release them from all
liability, not write something as complicated as a legal opinion. And
yes, as stated in #2 above, that has to be the reason. I have had to get
these releases in the past, and they need not be complicated.
My suggestion is to ask the school specifically what they need to be
protected from. If it becomes a seriously complicated matter, don't
participate with the school. My God, all you want to do is display some
images. All they want is a release absolving them of possible litigation.
It seems to me that a very simple document could be created. If there is
a problem with the document, you can bet it will not get approved by the
school's legal people.
One potential problem with a document like is being discussed, is that if
you agree not to hold the school liable, then it seems to me that if
someone is eager to sue, they will come after you. You might win, but
then again, your costs of defending yourself can be costly. Everyone is
very concerned these days about this matter, and the photographer should
be as well. It is too bad.
